Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Kali Rising ("Kali Rising", "we", "our", or "us") governing your use of the PawPhysio mobile application and related services (the "App" or "Service"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Definitions

"App" or "Service" means the PawPhysio application and related services. "Subscription" means a paid, auto-renewable plan. "User Content" means content you create or upload, including dog profiles, logs, notes, and photos. "App Store" means the platform from which you obtained the App — the Apple App Store or Google Play — and "Store Provider" means Apple Inc. or Google LLC respectively.

2. Eligibility & Acceptance

You must be at least 16 years old and able to form a binding contract to use the App. By using the App, you confirm that you meet these requirements and that the information you provide is accurate.

3. Relationship with the App Store

These Terms are between you and Kali Rising only, and not with Apple or Google. The Store Provider is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. Your use of the App is also subject to the applicable Store Provider's own terms, to the extent they apply.

If you obtained the App from the Apple App Store: Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you. Your use of the App is also subject to the Apple Media Services Terms and Conditions and the Apple Standard End User License Agreement, to the extent applicable.

If you obtained the App from Google Play: your use of the App is also subject to the Google Play Terms of Service, to the extent applicable.

4. Your Account

You must create an account to use most features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorised use.

5. Subscription, Billing & Auto-Renewal

PawPhysio offers a 7-day free trial, after which continued access to premium features requires an auto-renewable subscription. Two plans are available:

• Monthly — US$7.99 per month
• Annual — US$79.99 per year

Prices are shown in US dollars; you will be charged the local equivalent set by the applicable App Store, which may vary by country and is subject to local taxes.

Payment is charged to your Apple ID or Google Play account at confirmation of purchase. The subscription automatically renews unless it is cancelled at least 24 hours before the end of the current period, and your account will be charged for renewal within 24 hours prior to the end of the current period. Any unused portion of the free trial is forfeited when you purchase a subscription.

You can manage or cancel your subscription at any time:

• iPhone or iPad — Settings › your name › Subscriptions › PawPhysio.
• Android — Google Play Store › profile icon › Payments & subscriptions › Subscriptions › PawPhysio.

Deleting your PawPhysio account does not automatically cancel your subscription, because subscriptions are managed by the App Store rather than by us. Please cancel your subscription separately.

6. Refunds

Purchases and subscriptions are processed by the App Store from which you obtained the App, not by us. All payments and refunds are handled by that Store Provider in accordance with its own terms, and Kali Rising cannot process refunds directly. To request a refund:

• Apple App Store — use Apple's "Report a Problem" page at reportaproblem.apple.com, or your App Store account settings.
• Google Play — use Google's refund request page at support.google.com/googleplay, or your Google Play order history.

Nothing in this section limits any statutory refund or cancellation rights you may have under the consumer law of your country.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in breach of these Terms.
• Attempt to access other users' accounts or data without authorisation.
• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Upload or transmit content that is unlawful, abusive, or infringes the rights of others.

8. Intellectual Property

The App, including its design, features, and content (excluding User Content), is owned by Kali Rising and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use. No rights are granted to our trademarks or branding.

9. Your Content

You retain ownership of your User Content. You grant Kali Rising a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display your User Content solely to operate and provide the Service to you. You represent that you have all necessary rights to the content you upload.

10. Veterinary & Health Disclaimer

The exercises, metrics, scores, reminders, and other information in the App are provided for general informational and record-keeping purposes only, and do not constitute veterinary or professional advice. You must exercise your own judgement and consult a qualified professional regarding your dog's health and rehabilitation. To the fullest extent permitted by law, Kali Rising is not liable for any health outcome, injury, or loss arising from your use of, or reliance on, the App.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, Kali Rising and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App. Our total aggregate liability arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim, or US$50, whichever is greater. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or your mandatory consumer rights.

13. Indemnity

You agree to indemnify and hold harmless Kali Rising from any claims, damages, liabilities, and expenses arising from your breach of these Terms, your misuse of the App, or your User Content.

14. Termination

We may suspend or terminate your access to the App if you breach these Terms. You may stop using the App and delete your account at any time. Upon deletion, your data will be handled in accordance with our Privacy Policy. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. You agree to submit to the exclusive jurisdiction of the courts of Singapore to resolve any dispute arising out of or in connection with these Terms.

17. Third-Party Services

The App relies on third-party services including Apple and Google (payments and sign-in), Supabase (data storage and authentication, hosted on AWS), RevenueCat (subscription management), and Anthropic (the AI used for program import and progress insights). Your use of those services may be subject to their own terms and privacy policies. See our Privacy Policy for details of what data is shared with each.
